Negotiating Outcomes

The claims or commercial statements that have been developed throughout the process so far will inform you of your entitlement under the contract or provide your defence. This will allow your organisation to consider how to approach any negotiations.

Once this preparatory work has been done, it’s time to engage with the decision makers of the opposing party to find an amicable solution. This is the preferred option to avoid the need for costly and lengthy litigation. During the negotiation process the Modus team will either lead the negotiations or be on hand to provide advice.

Our commercial leaders have experience in negotiating outcomes through negotiation, conciliation or mediation on disputes ranging in value between £2 million – £600 million.

What if we can’t reach an amicable settlement?

While the goal will always be to settle matters amicably, sometimes this is not possible and the dispute will have to be referred to a third party determination.

Experienced in the management of disputes and associated proceedings, we will be there to coordinate works of the appointed legal counsel and any independent experts.
